General Terms and Conditions of Sale and Use

Article 1 — Purpose and scope

These general terms and conditions of sale and use (hereinafter the "Terms") govern, without restriction or reservation, access to the website myhomeprice.fr (hereinafter the "Site") and the purchase of the services offered thereon, between any adult natural person acting for non-professional purposes (hereinafter the "Customer") and the publishing company identified in Article 2 (hereinafter the "Seller").

Any order implies the prior, express and unreserved acceptance of these Terms, evidenced by a tick box during the ordering process. The applicable Terms are those in force on the day of the order. The Seller reserves the right to amend them at any time for the future; ongoing subscriptions remain governed by the version accepted, unless prior notice of at least 30 days is given before a new version takes effect.

Article 3 — Description of the service

The Site provides, in the form of digital content delivered immediately online, a set of property calculation tools accessible free of charge (hereinafter the "Figures"): estimation of a property's market value and prediction of its evolution over 5, 10 and 15 years (including a dual renovation scenario linked to the energy performance diagnosis), accessible after creating a free account; as well as the rental yield and cash-flow calculator, the negotiation simulator, the neighbourhood comparison tool, the "where to invest" ranking, and the price map, all freely accessible without an account. Projections are calculated by statistical extrapolation of trends observed in the relevant geographical area, based on the public "Demandes de valeurs foncières" (DVF) database (property value requests database), and presented in the form of scenarios (pessimistic, neutral, optimistic). The Figures do not require any payment.

The Seller offers, for a fee, a separate "AI Property Investment Report" service (hereinafter the "Report"), also referred to as the "AI Purchase Adviser". For a given property, the Report combines the estimation of its value, the projection of its evolution, the analysis of its energy performance diagnosis and renovation cost, the rental yield and comparable sales drawn from the DVF database, and adds an opinion generated by an artificial intelligence system: an assessment of the asking price, points requiring attention, and an estimate of a negotiation margin. The Report can be viewed online and downloaded in PDF format. It is provided under the pricing plans described in Article 5 (one-off payment report pack or monthly subscription). Reports from a pack purchased as a one-off payment have no limited period of validity; they are non-refundable (subject to Article 8) and may not be transferred or converted into cash.

The opinion contained in the Report is generated automatically and may contain errors or omissions; it has no contractual value, only the original documents being authoritative, and does not constitute a property diagnosis, nor technical, financial or legal expertise.

The Customer may attach to their Report request their diagnostic file (DPE, DDT) in PDF format; the analysis of this file is then included in the same Report, at no additional cost. The Seller may, based on diagnostic analyses, produce aggregated and anonymised statistics (categories of anomalies, order-of-magnitude costs, energy classes, geographical area) intended to improve the quality of the service; these statistics contain neither the uploaded document nor any data enabling identification of the Customer or the property.

Important notice: the estimates are provided for strictly indicative purposes. They do not constitute a property valuation, a statement of value, or investment, financial or wealth management advice, and cannot guarantee the actual future value of a property. Past trends are not indicative of future market developments.

Article 4 — Customer account

Creating a free account is necessary for the estimation and prediction tools (in order to save the results) and for any purchase of a Report; the other Figures are accessible without an account. The Customer undertakes to provide accurate information and to keep it up to date. Login credentials are strictly personal; the Customer is responsible for their confidentiality and for any use made of their account. Account creation is free and gives access to all the Figures, limited to one account per person; the Seller reserves the right to suspend accounts created in breach of this limit.

Article 5 — Price

The Figures (estimation, prediction, rental yield, negotiation simulator, neighbourhood comparison tool, "where to invest" ranking, price map) are provided free of charge. Only the AI Investment Report is charged for. Prices are stated in euros, inclusive of all taxes (VAT included). As at the date of this version, the offers are as follows:

• Pack of 3 reports: €9.99 inclusive of VAT, as a one-off payment, entitling the holder to three (3) AI Investment Reports, without subscription;
• Monthly subscription: €19.99 inclusive of VAT per month, entitling the holder to ten (10) Reports per monthly period, with tacit renewal (see Article 7).

The Seller may change its prices at any time; the applicable price is that displayed on the day of the order. For the subscription, any price change will be notified to the Customer at least 30 days before it takes effect, and the Customer may cancel before that date.

Article 6 — Payment

Payment is made online by credit/debit card, via the payment service provider Stripe Payments Europe, Ltd. Card data is collected and processed exclusively by Stripe, which is PCI-DSS certified; the Seller has no access to it and does not store it. The order is deemed final once payment is confirmed. In the event of failure to pay a subscription instalment, access to the Reports for the period concerned is suspended until payment is regularised; failing this, the subscription is terminated automatically.

An invoice is issued for each payment and remains available for download at any time from the "My Account" page.

Article 7 — Subscription: term, tacit renewal and cancellation

The subscription is entered into for a term of one (1) month, tacitly renewed for successive one (1) month periods. In accordance with article L215-1 du Code de la consommation (French Consumer Code), the Customer may terminate the renewal at any time.

Cancellation is carried out online, free of charge and without justification, from the management area accessible on the "My Account" page (secure Stripe portal). It takes effect at the end of the current monthly period. No pro rata refund is made for a period already begun. The Reports included in the subscription are allocated per monthly period; any not used during a period are not carried over to the following period. Reports already generated before cancellation remain accessible from the Customer's account.

Article 8 — Right of withdrawal

In accordance with article L221-28, 13° du Code de la consommation, the right of withdrawal cannot be exercised for the supply of digital content not provided on a tangible medium whose performance has begun before the end of the withdrawal period, with the consumer's prior express agreement and express waiver of their right of withdrawal.

With each order, the Customer expressly consents, by ticking a box, to the immediate performance of the service and acknowledges that they thereby lose their 14-day right of withdrawal. Confirmation of this consent is provided to them on a durable medium (order invoice). Consequently, no refund is due once performance has begun, i.e. as soon as a Report has been generated; reports from a pack not yet used remain available without any time limit.

Article 9 — Statutory guarantees

The Customer benefits from the statutory guarantee of conformity applicable to digital content and services (articles L224-25-12 et seq. du Code de la consommation): in the event of a lack of conformity of the service (for example, inability to access a paid Report), the Customer may obtain its remedy free of charge and, failing that, a price reduction or termination of the contract. Complaints should be sent to contact@myhomeprice.fr.

Article 10 — Liability

The Seller is bound by an obligation of means. It cannot be held liable for: (i) decisions of any kind whatsoever (purchase, sale, investment, financing, works) made by the Customer on the basis of the estimates; (ii) discrepancies between an estimate and the actual, present or future, value of a property; (iii) inaccuracies, gaps or delays in updating affecting the source public data; (iv) temporary unavailability of the Site for maintenance, updates or force majeure within the meaning of article 1218 du Code civil; (v) the content of the opinion generated by artificial intelligence, provided for information purposes only, which does not constitute a property valuation or investment advice, and the automated and fallible nature of which the Customer acknowledges with each order.

In any event, and save in the case of gross or wilful misconduct, the Seller's total liability is capped at the total amount actually paid by the Customer during the twelve (12) months preceding the event giving rise to liability. No provision of these Terms excludes or limits the Seller's liability in the event of personal injury or in cases where the law prohibits such limitation.

Article 11 — Intellectual property and use of reports

The estimates and PDF reports generated are intended for the Customer's strictly personal and private use. Any resale, public redistribution or commercial exploitation, direct or indirect, is prohibited without the Seller's written consent. The elements of the Site remain protected under the conditions set out in the legal notice. In particular, the Customer shall refrain from any automated collection of Site data (robots, scripts, "scraping"), any substantial extraction from its databases (art. L. 342-1 du Code de la propriété intellectuelle (French Intellectual Property Code)), and any circumvention of technical access-limitation measures.

Article 12 — Personal data

Personal data processing related to the performance of these Terms is described in the Privacy Policy.

Article 13 — Consumer mediation and disputes

In the event of a complaint, the Customer is invited to contact the customer service department in the first instance at contact@myhomeprice.fr. In accordance with articles L612-1 et seq. du Code de la consommation, if no amicable resolution is reached within 60 days, the Customer may have free recourse to a consumer mediator.

The Customer may also use the European online dispute resolution platform: ec.europa.eu/consumers/odr.

Article 14 — Governing law and miscellaneous provisions

These Terms are governed by French law, without prejudice to any more favourable mandatory provisions of the consumer's country of residence. Should any provision hereof be held void, the remaining provisions shall retain full force and effect. The Seller's failure to enforce any breach shall not constitute a waiver of its right to do so subsequently. Failing an amicable or mediated resolution, the dispute shall be brought before the competent French courts under ordinary law conditions.
